Terms of service

These terms govern access to the public website, demo, and Codenergy platform. The commercial terms agreed with each customer supplement and, in case of conflict, prevail over this text.

1. Acceptance and provider

By accessing or using Codenergy, you accept these terms and confirm that you have the capacity to be bound or authority to act for the organization you represent. If you disagree, you must not use the service.

Codenergy is the service brand. The applicable proposal, order form, or agreement identifies the provider, customer, plan, price, term, service levels, and other commercial conditions.

2. The service

Codenergy is a platform for managing accreditation and access, execution and ITRs, punch lists, progress, contractual acceptance, and dossiers for solar and BESS projects. It organizes information and workflows; it does not replace professional judgment, field supervision, risk prevention, or decisions by authorities, coordinators, owners, lenders, or inspectors.

Available features may vary by plan, pilot, configuration, and role. Current commercial documentation describes the contracted scope.

3. Accounts and access

The customer manages who has access and under which role. Each user must:

  • Provide current and accurate registration information.
  • Protect access links, passwords, and devices, and never share personal credentials.
  • Use only organizations, projects, and data they are authorized to access.
  • Promptly report lost access, suspected abuse, or a security incident.

4. Customer data and content

The customer retains its rights in uploaded data and documents. It gives the provider a limited authorization to host, copy, process, and display them only as needed to provide, protect, and support the service.

The customer is responsible for the legality, quality, accuracy, and support of what it uploads, for informing affected people, and for retaining originals where required by law or contract. Codenergy statuses and certificates reflect information available in the system; they do not make inaccurate data true or replace an external legal or technical certification.

5. Acceptable use

You may not use Codenergy to:

  • Carry out unlawful or fraudulent activities or infringe third-party rights.
  • Access, attempt to access, or disclose another organization’s or user's data without authorization.
  • Bypass controls, test vulnerabilities without authorization, or interfere with service availability.
  • Upload malware, harmful code, or content intended to compromise systems or people.
  • Copy, resell, or exploit the platform beyond what the agreement or law permits.

6. Demo and pilots

The public demo uses fictional data, may reset without notice, and is provided for evaluation. It must not be used to store real data, operate a site, or make decisions. Pilots may have additional limits set out in their proposal.

7. Availability and changes

We work to keep the service available and secure, but maintenance, incidents, or third-party dependencies may occur. We may change features to improve security, compliance, or the product, while seeking not to materially reduce the contracted scope during its term without notice or an agreed alternative where appropriate.

8. Intellectual property

The platform, code, design, trademarks, documentation, and first-party content belong to the provider or its licensors. Access grants a limited, non-exclusive, non-transferable, revocable right to use the service during the applicable relationship; no intellectual property is transferred.

9. Confidentiality and personal data

Each party must protect the other's confidential information and use it only for the agreed relationship. Personal data processing is also governed by the Privacy Policy, the agreement, and, where appropriate, a data processing agreement.

10. Warranties and liability

Codenergy is provided with reasonable care and according to the contracted scope. Except for express contractual warranties or those that cannot be excluded by law, we do not guarantee that every feature will be uninterrupted or that user-uploaded information is accurate or sufficient for a technical, contractual, or regulatory decision.

The allocation and limits of liability are set out in the commercial agreement. Nothing in these terms excludes liability that cannot be limited by law or permits the customer to disregard its own safety, labor, technical, or regulatory obligations.

11. Suspension and termination

We may limit or suspend access where needed to contain a security risk, comply with law, prevent harm, or respond to a material breach, with notice where reasonable. Termination, export, and deletion of data follow the applicable agreement and legal periods.

12. Governing law, changes, and contact

These terms are interpreted under the laws of Chile, without prejudice to any mandatory rules that apply. We may update them by publishing a new date; material changes for active customers will be communicated through an appropriate channel. Questions may be sent to hola@cod.energy.
